The House settlement represents a fundamental restructuring of collegiate athletics. As we navigate this new era, it is crucial for athletes and their families to understand the legal and strategic shifts that demand a proactive approach to their NIL journey.
Increased Financial Opportunity and Institutional Liability
The most significant shift is the allowance for institutions to share athletic revenues directly with athletes. This move away from the amateurism model creates new financial avenues beyond third-party endorsements.
What does this mean for you?
For athletes, this creates a potential for direct income from their university.
For institutions, it introduces significant new compliance and liability burdens, requiring meticulous diligence in how these payments are structured and reported to avoid legal trouble.
The Enduring Need for Legal Due Diligence: A Practical Guide
While the new rules seem to loosen restrictions, the legal obligations for athletes remain. It is more critical than ever to conduct thorough legal due diligence on every NIL opportunity. Here’s a breakdown of what that means in practice:
Review Every Contract: Do not sign any agreement without a professional legal review. Understand every clause, including duration, exclusivity, and termination terms. An exclusive deal, for instance, could prevent you from pursuing other, potentially more lucrative partnerships.
Know Your Rules: Every deal must comply with evolving NCAA rules, your state's specific NIL laws, and your university's policies. The new NIL Go system is designed to scrutinize deals over $600 to ensure they represent fair market value and are not "pay-for-play." Understand that a deal can be flagged, rejected, or require revision, and you may face eligibility consequences if you proceed with a non-compliant deal.
Avoid "Booster" Entanglements: Be cautious of deals from boosters or school-affiliated entities that could be misconstrued as improper recruiting inducements. This area is still a major focus for enforcement.
The Mandate for Legal and Financial Literacy
NIL compensation transforms athletes into independent contractors. This comes with significant tax responsibilities that are often new and complex for athletes and their families.
Understand Your Tax Obligations: Unlike a traditional job, taxes are not automatically withheld from most NIL payments. You will likely receive a Form 1099-NEC if you earn $600 or more from a single source. It is your responsibility to set aside money for taxes, often 20-30% of your earnings. You may also be required to make quarterly estimated tax payments to the IRS to avoid penalties.
Track Everything: Keep meticulous records of all income and expenses related to your NIL activities. This includes cash and "in-kind" compensation (like merchandise or services). This documentation is crucial for correctly filing your taxes and maximizing deductions for things like travel or training expenses directly tied to a deal.

NIL Deals Are Stuck in Purgatory

The College Sports Commission's NIL Go clearinghouse is causing significant delays in approving NIL deals, leaving many athletes in limbo.
Despite having approved thousands of deals, the manual review process is struggling to keep up, causing some athletes to lose opportunities with tight deadlines.
This ongoing issue is raising concerns about potential lawsuits and the long-term efficiency of the new system.
Chipotle Expands NIL Program to Gators and Bulldogs

Chipotle is expanding its NIL program, which offers free meals to athletes, from Ohio State to include Florida and Georgia for the upcoming school year.
The program will provide custom Chipotle cards to nearly 2,000 student-athletes at the three schools. In addition to the free meals, student-athletes from the partner schools will be featured in new Chipotle advertisements.
Updates on Evolving Rules/Regulations
NIL Disclosure: A New Era for Incoming Athletes

The NCAA is proposing a new rule that would require incoming Division I athletes to disclose all high school or junior college NIL deals to the NIL Go clearinghouse.
This initiative aims to increase transparency and prevent "pay-for-play" arrangements between boosters and prospective athletes. Failure to comply with these new regulations could potentially result in lost eligibility for the athletes.
Wisconsin Sues Miami Over NIL Tampering of Player

The University of Wisconsin is seeking legal access to the communications of former cornerback Xavier Lucas and the University of Miami in a lawsuit over alleged tampering with his NIL contracts.
Lawyers for Wisconsin argue that Miami's motion to dismiss the case should be denied, as they believe the records will prove that Miami engaged in improper contact with Lucas before his transfer.
